Gans Man Enters Not Guilty Plea to Charges


A Gans man was charged last week in Sequoyah County District Court, Sallisaw, with felony charges of assault and battery with a dangerous weapon and larceny of an automobile, and misdemeanor charges of domestic abuse, leaving the scene of an accident involving damage and public intoxication.

Darin Wayne Schmidt, 26, entered a not guilty plea to the charges on Dec. 27 in district court. He was released from the county jail on Jan. 2 on a $16,500 bond. His next court appearance is slated for Jan. 17 on Associate District Judge Kyle Waters disposition docket.

According to the police report filed with the charges, Schmidt was seen to be grabbing his sister by her hair, “slinging her around and throwing her knees against the vehicle door frame.” The assault allegedly occurred at about 6:20 p.m. on Dec. 19 at the Quickway Convenience Store in Muldrow.

The report goes on that a witness yelled for Schmidt to stop the alleged attack, and he began an argument with the witness and then hit her with a baseball bat. When another female witness jumped from her vehicle to run for help, Schmidt was reported to have jumped in her vehicle and driven off.

According to the report, Schmidt then “drove north on Main and turned in behind the Muldrow Laundry Mat and hit the corner of a residence at 804 S. Main where the vehicle came to a stop.” Schmidt ran from the scene, according to the report.

Schmidt was arrested at about 8:31 p.m. on Dec. 19 on another domestic call and brought to the Muldrow Police Department where he was identified as the suspect in the earlier altercation.
