Angela Gray Preliminary Set for Oct. 10

A preliminary date on a conspiracy charge was set for Oct. 10 for Angela Gray, 40, of Muldrow.

Gray was charged Aug. 31 in Sequoyah County District Court in Sallisaw with conspiracy, child endangerment by driving under the influence, and selling or furnishing alcoholic beverages to a minor, all felonies.

Gray, her son Joey, and another young man, Kyle Brannon, were all charged with conspiracy for allegedly covering up the ATV crash on Sept. 1, 2013, south of Muldrow that left Christian Mayberry with severe brain trauma as a result of the crash. A mistrial was declared after the jury deadlocked last month on another set of charges against Gray related to the same incident. At that time Assistant District Attorney Michael Ashworth said he would try the case again.

At Gray's arraignment Sept. 10, her attorney Gary Buckles of Poteau said he intended to file motions in the case, and he filed a motion for discovery on Sept. 11. In the motion he asks for "all evidence of any sort generated by the police or the district attorney..." He also requests all audio and video recordings and all photographic material regarding the case.

In the related case involving Gray's son Joey, District Judge Jeff Payton cleared the courtroom at Joey Gray's initial arraignment Sept. 10 because Joey Gray was a juvenile at the time of the incident. The case records reveal that Judge Payton did not allow the charges to move forward on Joey Gray's case, and Ashworth announced he intended to appeal the judge's decision. Joey Gray's attorney argued that the charge information was the same as previous charges that were not pursued.

There was no new information in Brannon's case file as of Sept. 22.
